Terms of Service

Last updated: October 18, 2026

These terms are an agreement between you and Jason Calavaza, an individual based in Phoenix, Arizona, doing business as Online Kitchen ("Online Kitchen", "we", "us"). They cover onlinekitchen.fyi, every truck ordering page on it, and the kitchen portal (together, the "Service"). By creating an account or placing an order, you agree to them.

1. What the Service does

The Service gives food trucks and other food vendors ("Trucks") an online ordering page and a kitchen portal. Customers use a Truck's page to order from that Truck. We provide software only. We do not cook, sell, or deliver food, we are not the seller of anything ordered, and we are not a party to any sale between a Truck and a customer.

2. United States only

The Service is offered only to Trucks operating in the United States and to customers ordering from them. It is not directed at people in the European Union, the United Kingdom, or anywhere else outside the United States, and we do not market it there. If you use it from outside the U.S., you do so on your own initiative and you are responsible for following your local laws.

3. Who can use it

4. Truck responsibilities

Each Truck is the seller of its food and is solely responsible for:

Trucks may only use the Service for lawful food and beverage sales and may not impersonate another business or use a page name or web address meant to mislead.

5. Plans and billing

The Free plan costs nothing. Paid plans (Pro, Pro+ and Business) are subscriptions billed in advance through Stripe that renew automatically until you cancel. You can cancel any time from Settings → Plan & Billing; paid features stay on until the end of the period you already paid for. Subscription payments are non-refundable except where the law requires otherwise. We will give at least 30 days' notice before changing the price of your plan.

6. Online payments and text messages (Pro)

If a Truck turns on online payments, it connects its own Stripe account and agrees to Stripe's terms. Customer payments go directly to the Truck's Stripe account. The Truck is the merchant and is responsible for refunds, disputes, and Stripe's fees. We do not take a cut of sales.

If a Truck turns on text alerts, it agrees to text only customers who asked for a text at checkout, and only about their order. Customers can reply STOP to any text to opt out. Message and data rates may apply.

7. The free beta

While the Service is in beta, paid features may be open to everyone for free. Beta features can change, move to a paid plan, or be removed. Before a feature you use moves to a paid plan, we will tell Trucks by email or in the kitchen portal, and nothing is charged unless you choose a plan. You can download your data at any time from Settings.

8. Smart features (AI)

Some features use artificial intelligence to save you time: reading menu photos, product labels and receipts, writing up what you say out loud (menu items, schedule stops, catering calls, expenses), writing posts, and The Window. To do this, the photo, recording or words you choose are sent to our AI providers (Anthropic, and OpenAI for turning speech into text), used only to give you the result, and not kept by us after they are read, except receipts you choose to keep with an expense.

9. Estimates, not advice

Sales tax rates, tax to set aside, expense categories, plate costs, catering totals, wait times, insights and similar numbers in the Service are estimates to help you run your business. They are not tax, accounting, legal or financial advice. Check important numbers with a qualified professional.

10. Customers

Your order is with the Truck, not with us. Questions about food, allergies, pickup, payment, or refunds go to the Truck. Order times and wait estimates are estimates only.

11. Your content

Trucks keep ownership of their menus, photos, and logos, and give us permission to host and display them to run the Service. Only upload content you have the right to use.

12. Suspension and deletion

We may suspend or remove pages that break these terms, are used for fraud, or put others at risk. You can delete your account any time from Settings → Account. Deletion is permanent.

13. No warranty

The Service is provided "as is" and "as available." We work hard to keep it running, but we do not promise it will be uninterrupted, error-free, or that every order or text will arrive.

14. Limit of liability

To the fullest extent the law allows, we are not liable for lost profits, lost sales, lost orders, or indirect, incidental, or consequential damages, and our total liability for any claim is limited to the greater of $100 or the amount you paid us in the 12 months before the claim. We are not responsible for food, illness, injury, or anything else caused by a Truck.

15. Indemnity

If you are a Truck, you agree to defend and cover us against claims, losses, and costs (including reasonable attorney fees) that come from your food, your sales, your content, your taxes, or your breaking these terms or the law.

16. Governing law and where disputes go

These terms are governed by the laws of the State of Arizona and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute will be brought only in the state or federal courts located in Maricopa County, Arizona, and you and we agree to those courts' jurisdiction. Either side may use small claims court for claims that qualify.

17. Changes

We may update these terms. If a change is significant, we will tell Trucks by email or in the kitchen portal before it takes effect. Continuing to use the Service after that means you accept the new terms. We may transfer these terms, and your account, to a company we form or control to run Online Kitchen (for example, an Arizona limited liability company). We will tell Trucks by email when that happens; your account, data and plan carry over unchanged.
